What changed January 1, 2026
  • 1A tenant late for the first time must get a notice to pay rent or vacate, not a plain notice to vacate. Property Code 24.005(a).
  • 2Four delivery methods only: mail, inside the premises, hand to a tenant 16 or older, or email if agreed in writing. Outside door posting is gone. 24.005(f-3).
  • 3A last day on a weekend or holiday rolls to the next business day. 24.0042.
  • 4The petition must be sworn and state the notice type, delivery date and method, and whether the tenant was late before. Rule 510.6.

When can I file? Check your dates.

Free. The same math our notices use.

This is day 0. The count starts the next day.

3 days unless your written lease sets a different period. Property Code 24.005(a).

Mailed notices count from an assumed receipt date 3 days after mailing.

Under Property Code 24.0042 the day of delivery is day 0, weekends and holidays count, and a last day that falls on a Saturday, Sunday or state or federal holiday moves to the next business day. We treat every state and federal holiday as a holiday, which can only lengthen the period.

The free templates are wrong

Posting on the outside of the door stopped counting on January 1, 2026. Most free Texas forms still list it, and none picks the notice to pay rent or vacate a first time late tenant must get.

The big form sites are a subscription

The free preview turns into $37 to $49.95 a month. Texas Notice is $19 once. No trial, no card to preview, no auto renew.

The dates are the whole case

Deliver Wednesday and the third day is Saturday, so the period runs through Monday and you file Tuesday. File a day early and the case is dismissed. We compute it.

Questions landlords ask

Do weekends count toward the 3 day notice in Texas?

Weekends and holidays count, but under Property Code 24.0042 a last day that falls on one moves to the next business day.

Can I text or email a notice to vacate in Texas?

Email or other electronic notice counts only if the tenant agreed to it in writing under Property Code 24.005(f-3).
