Under Property Code 24.0042 the day of delivery is day 0, weekends and holidays count, and a last day that falls on a Saturday, Sunday or state or federal holiday moves to the next business day. We treat every state and federal holiday as a holiday, which can only lengthen the period.
How the count works
- The day you deliver is day 0. Delivered Wednesday, Thursday is day 1.
- Count every calendar day, including Saturday, Sunday and holidays.
- If the last day lands on a Saturday, Sunday or a state or federal holiday, the tenant has through the next business day.
- File on the day after the last day. Most courts accept e-filing at selfhelp.efiletexas.gov around the clock.
Questions landlords ask
Do weekends count toward the 3 day notice period in Texas?
Weekends and holidays count, but under Property Code 24.0042 a last day that falls on a Saturday, Sunday or holiday moves to the next business day.
Does the day I deliver the notice count?
No. The day of delivery is day 0 and the count starts the next day.
When can I file the eviction after a 3 day notice?
The day after the notice period ends. If you deliver on a Wednesday, the third day is Saturday, the period runs through Monday, and you can file Tuesday.
Does a mailed notice count from the day I mail it?
The statute says the notice must be delivered, and many justice courts count from receipt. This calculator adds 3 days for mail. Hand delivery or leaving it inside the premises avoids the question.
