How to deliver a notice to vacate in Texas

Since January 1, 2026, Texas allows four delivery methods: mail, delivery inside the premises, hand delivery to a tenant 16 or older, or email if the tenant agreed in writing.

Build a notice with the delivery declaration included

The four methods, Property Code 24.005(f-3)

Actual receipt cures any method defect (24.005(f-4)).

  • Mail: first class, registered, certified, or a commercial delivery service such as UPS or FedEx
  • Delivery to the inside of the premises in a conspicuous place
  • Hand delivery to any tenant who is 16 or older
  • Electronic communication, including email, if the parties agreed in writing

What no longer works

Former subsections (f) through (i), which allowed posting on the outside of the main entry door in a sealed envelope marked IMPORTANT DOCUMENT with same day mailing, were repealed. A notice taped to the outside of the door on or after January 1, 2026 is not a permitted method unless the tenant actually receives it.

Can I text or email?

Only if the tenant agreed in writing. A general electronic communication clause in an older lease may not be enough; the safer practice is a specific clause consenting to electronic delivery of notices under Property Code 24.005, with the address to use. If you are not sure, email and also hand deliver or mail.

Which method to pick

Hand delivery to an adult tenant is the cleanest proof. Leaving it inside the premises works when you have a lawful reason to enter. Mail is permitted, but the statute says the notice must be delivered, and many justice courts count from receipt, so allow extra days. Certified mail that the tenant refuses is a weak record; send first class too.

Prove it

Sign a declaration of delivery the same day with the date, method, and recipient, and photograph the notice in hand or in place. The 2026 petition asks for the delivery date and method, and Travis County and others require a copy of the notice at filing.

Questions landlords ask

Can I tape the notice to the door?

Not on the outside. Since January 1, 2026 the permitted methods are mail, inside the premises, hand delivery to a tenant 16 or older, or agreed email.

Can I put it in the mailbox?

Only the Postal Service may place items in a mailbox. Mail it, or hand deliver it.

Does a text message count?

Only if the tenant agreed in writing to electronic notice. Without that, a text is not a permitted method, though actual receipt cures the defect.
